Tax residence certificate: What is it and what is it used for?

Have you been asked for a certificate of tax residence in Spain but you don’t know what it is?

What is the certificate of tax residence in Spain?

The certificate of tax residence in Spain is an official document issued by the Tax Agency that proves that a person is a tax resident in Spain, which means that he or she is obliged to pay taxes in this country.

The application for the certificate of tax residence in Spain is made through the Tax Agency’s website and it is automatically sent by post to the notification address you have with the tax authorities. If the result is negative, you will have to provide documentation to prove your residency.

This certificate is necessary to correctly process certain formalities, such as avoiding double taxation, and is an official document that proves the tax residency of a person or entity in Spain.

The required documents for the request include:

a) Personal identification:

This includes your name, surname, NIF (fiscal identification number), and address.

The Spanish tax agency, known as the Agencia Estatal de Administración Tributaria (AEAT), is responsible for issuing the certificate of tax residence in Spain.

What information is included in a tax residence certificate?

The information included in a fiscal residence certificate in Spain is as follows:

  1. Personal information: This includes the name and surname of the person requesting the certificate, their NIF (fiscal identification number), and their address.
  2. Residency information: The certificate confirms whether the person is a resident or non-resident for tax purposes in Spain.
  3. Information on fiscal representation: If the person is a non-resident, the certificate may include information about their fiscal representative in Spain.
  4. Information on fiscal conventions: If the person is a resident, the certificate may include information about fiscal conventions between Spain and other countries to avoid double taxation.
  5. Date of issue: The certificate includes the date it was issued, which is important for its validity period.

The tax residence certificate is an important document for taxpayers in Spain and is necessary to demonstrate tax residence and pay taxes correctly in the country. The lack of this certificate can lead to problems in the tax declaration process and the impossibility of proving tax residence in Spain and to ask in your country to don’t get taxes there.

Do i need my tax certificate to open a bank deposit?

If you are trying to open a bank deposit in another country it is very useful. The bank will ask you for the certificate to verify your tax residency, this will determine the tax you have to pay on the interest you may earn.

The certificate will also help you avoid paying the same tax in both countries if Spain has a double taxation agreement with the country where the bank is located.

What is considered tax residence?

Tax residence or “Residencia fiscal” in Spain refers to the legal status of a person that identifies the country with which they have tax obligations.

In Spain, residency for tax purposes is regulated by specific rules and to become a tax resident, it is necessary to declare the world income to the Spanish tax authorities. Residents in Spain must pay taxes on their worldwide income, including income earned both in Spain and abroad (with some exceptions, such as the “Beckham Law” regime). Non-residents, on the other hand, only pay taxes on income of Spanish origin.

To determine tax residency in Spain, one of the following criteria must be met:

  1. Physical presence: If you spend more than 183 days in Spain in a calendar year, you are automatically considered a tax resident. These days do not have to be consecutive, allowing for accumulation over time.
  2. Economic ties: If your main economic interests are in Spain, such as owning a business or having significant financial assets, you may be considered a tax resident even if you spend less than 183 days in the country.

The concept of tax residency is crucial for individuals as it determines their tax obligations.

For those living abroad, understanding how tax residency works in Spain is essential, as it affects their financial management and compliance with tax laws.

The certificate of tax residency is a document that accredits a person’s tax residency status in Spain and is often required for tax purposes, such as when declaring income or applying for tax benefits. The certificate has a validity period of one year, although it can be extended in certain cases.

The certificate of tax residency is a key document for demonstrating tax residency status and fulfilling tax obligations.
