This means that if an individual has different residences in different Autonomous Communities, they must file the tax return in the region where they resided at the time of the donation (the day on which the act or contract that gives rise to the donation occurred).

Tax calculation and form 651

The calculation of the Inheritance and Gift Tax is done through Form 651. The value of the vehicle serves as the starting point for calculating this tax. A progressive tax rate is applied, meaning that the tax rate increases as the value of the vehicle increases.

Bonuses and requirements

Starting from April 11, 2019, bonuses were introduced in the Inheritance and Gift Tax for donations made between certain kinship groups. These groups are defined in Article 20 of the Inheritance and Gift Tax Law.

  • Group I: Includes descendants, whether natural or adopted, who are under 21 years of age.
  • Group II: Encompasses descendants and adopted individuals who are 21 years old or older, as well as spouses, ascendants, or adopters of any age.

For donations between donors and donees in Groups I and II, a 99% bonus is applied to the tax amount. To be eligible for this bonus, the donation must be formalized in a public document.
