Haags apostilleverdrag: legalisatie van buitenlandse documenten

At times, we come across the recommendation to obtain an “apostilled” document (referring to The Hague Convention among the 133 signing countries) or a “legalized” document (for countries not part of The Hague Convention), terms that can cause confusion. In this article, we will unravel the meaning of The Hague Apostille and its significance in the international legal realm.

1. Definition of The Hague Apostille: What is it?

The Hague Apostille is a simplified procedure designed to have legal documents issued in one country automatically recognized by authorities in another state. This process is valid among the 133 nations participating in the international cooperation agreement. The Apostille, a note certifying the authenticity of the signature on public documents, is placed on the reverse side or on an additional page dedicated exclusively to this purpose.

In simple terms, The Hague Apostille is an international endorsement that eliminates the need to legalize foreign public documents for validity in another country that is a signatory to the same convention.

2. Which Documents Can Be Apostilled?

All documents issued by state entities are eligible to receive the corresponding apostille. This includes judicial, administrative, and notarial documents, with the caveat that the apostille of notarial documents is limited to Notary Associations.

2.1 Documents eligible for Apostillation:

  • Judicial documents
  • Administrative documents
  • Notarial documents (exclusively by Notary Associations)

2.2 Documents NOT eligible for Apostillation:

  • Documents issued by diplomatic or consular officials.
  • Administrative documents directly related to commercial or customs operations.

3. Apostille for Law Firms:

The Hague Apostille not only impacts individuals but also holds significant implications for legal entities and commercial organizations. For instance, when a company seeks legal services in territories where it lacks a physical presence, the Apostille streamlines the process by validating documents such as notarized powers necessary to authorize third parties to act on its behalf.

In conclusion, The Hague Apostille is a key instrument in facilitating the international validity of legal documents, eliminating the need for complex legalization processes. Its application benefits not only individuals but also plays a fundamental role in the international business and legal arena.

When discrepancies arise between the recorded size of a property or plot in the deed description and its actual built size, complications may arise. Such variations often stem from unreported extensions to a property or the segregation of a plot without proper notification to authorities like the Land Registry or Cadastre Office. These disparities can pose challenges when seeking a mortgage, as financial institutions require accurate property registration. To rectify this, a new deed must be created, disclosing any changes and specifying the actual size. This process involves obtaining a Certificate from a qualified Architect detailing the correct measurements, which must then be officially registered with the Land Registry.
