Golden Visa in Spain: Residency by Investment

Golden Visa for Investors

The residency through investment or Golden Visa is the optimal residency authorization for non-EU nationals seeking to invest in real estate within Spain.

What are the requirements to get a golden visa?

Besides the financial obligations, acquiring a Golden Visa in Spain involves meeting specific non-financial criteria, which comprise:

  1. Being a minimum of 18 years old.
  2. Possessing valid health insurance, either public or private, from an accredited provider in Spain.
  3. Showing sufficient financial resources to sustain personal and family expenses while residing in Spain.
  4. No record of being refused entry into any Schengen nation.
  5. No previous unauthorized entry or residency in Spanish territory.
  6. Maintaining a clear criminal record in both Spain and your country of residence within the past 5 years.

How long does the Spanish Golden Visa last?

The duration of the Golden Visa in Spain hinges on the point of application submission, whether it’s done domestically, necessitating legal residency in Spain, or from overseas.

For applications made from abroad, the initial residence permit spans one year. Conversely, if the application is made within Spain, the initial permit extends to two years.

Following the expiry of the initial permit, beneficiaries have the opportunity to seek visa renewal, resulting in the issuance of an additional 5-year residence permit.

Successful renewal necessitates meeting two key criteria:

  1. Presenting evidence of the continued validity of the initial investment that led to obtaining the Visa.
  2. Undertaking at least one visit to Spain during that year.

What are the benefits of obtaining a Golden Visa in Spain?

The advantages linked to obtaining a Spanish residency through the Golden Visa are substantial. Holding a Spain Golden Visa entails:

  1. Access to the EU (Schengen area) for travel purposes.
  2. The ability to apply for the same permit for your spouse or partner, minor children, or financially dependent adult children, as well as dependents in the ascending line.
  3. Non-EU investors interested in residing in Spain for a longer period can apply for renewal of the residence permit for successive 5-year periods, provided the conditions are met.
  4. Right to work as an entrepreneur or employee upon receiving the 2-year permit.
  5. Possibility of obtaining permanent residency after five years and citizenship after ten years.

Which family members are eligible for Spain’s Golden Visa?

Upon approval of the application, family members including spouses or individuals in a comparable relationship, dependent children under the age of 18, parents who are financially dependent on the applicant, and individuals financially reliant on the applicant and have not established their own family unit, will be granted their own residence permits. They can then enjoy the same privileges as the primary applicant.

What taxes will I have to pay once I have the Spanish Golden Visa?

The Golden Visa in Spain doesn’t mandate immediate tax payments; instead, it’s contingent upon the duration of residency in the country. If your residency exceeds 183 days annually, you’re obligated to declare your total income.

Nevertheless, what you must report to the Spanish authorities are the profits derived from your investment.

The end of end of Golden Visa incentive

The Spanish government has announced in April 2024 its intention to eliminate the possibility of obtaining Spanish residency in exchange for a minimum investment of €500,000 (known as the ‘Golden Visa’). The details of this draft law are not yet known.
